Terms & Conditions

General

1. This website is owned by Excel Video Productions, 55 Upper Stoneyfield, Harlow, Essex, CM19 4BD, described as either we, us or our.  The customer being referred to as either you, anyone or the customer.

2.  You must be 18 years of age or over to use this site.

3.  You agree that email can be used as a long-distance means of communication.

4.  All credit/debit card transactions are processed through 'PayPal' please click here for information on PayPal.

5.  We aim to ship all orders within 48 hours of payment.  Please note that orders paid by cheque will require bank clearance before shipping (usually 7 working days)

6.  If you are ordering from outside the United Kingdom, you may be subject to import duties and taxes which are levied once a shipment reaches your country.  Any such additional charges for customs clearance must be borne by you.  We advise you to contact your local customs office for further information.

7.  Please note that when shipping products internationally, you should be aware that cross-border shipments are subject to opening and inspection by customs authorities.

8.  It is a crime to use a false name or a known invalid credit card to order.  All orders placed using somebody else's credit/debit card must be done with full permission of the credit card holder.  Anyone caught wilfully entering a fictitious order will be prosecuted to the fullest extent of the law.

9.  All payments made through this site are invoiced in Pounds Sterling (£) or (GBP).  Customers from outside the United Kingdom may find that their credit/debit card companies may charge a currency conversion fee.  We recommend that customers check with their card companies before ordering.  All additional fees are to be borne by the customer.

Returns

Under the distance selling regulations you have a 7 working day cooling off period, starting from the day after you receive your goods.

To return goods you must send us written confirmation either by post or email within this period.  You will be responsible for the cost and the safe return of the goods in new unopened condition.  Once received you will be refunded the product cost only.  Original postal charges will remain.

Should any item be returned damaged a 15% repackaging charge will apply.

Should any item be returned with the packaging seals broken, where the item has been opened, these items will be returned back to you and no refund will be issued.

Faulty Goods

In the unlikely event that you receive a product which is faulty, damaged on receipt or sent in error by us, a replacement product will be supplied at our cost once we have received the faulty product back and testing has taken place.  You must inform us of any such instances within 7 working days of receiving your order.

Refunds can only be issued if the goods are received back unopened or in unique circumstances but at our sole discretion.

Should you receive a wrong item sent by us in error, we will arrange for the incorrect item to be replaced at our cost.  All incorrectly sent items MUST be reported in writing within the 7 day cooling off period and be sent back unopened and in new condition.

 

Copyright

All of our DVDs, Videos, Course notes and basic block patterns are protected by international copyright laws.  You run the risk of heavy penalties if you commit copyright infringement - in other words, use of copyright material without the copyright owners permission.  This means you must not:

  • Copy our work, in whole or in part unless licensed by us.
  • Lend or rent copies to the public unless licensed by us.
  • Perform, show or play work in public unless licensed by us.
  • Broadcast our work.
  • Make adaptations to our work.
  • If you infringe our copyright, you could be taken to court and run the risk of having to pay damages and compensation to the copyright owner.  You also face:

  • Having an injunction taken out against you to stop you using the copyright material
  • Being ordered to surrender the copyright material to the copyright owner.
  • Deliberate infringement of copyright on an industrial scale can be a criminal offence.  This carries an unlimited fine and up to 10 years imprisonment.

    You MUST get written permission in the form of an official licence issued by us if you want to rent, loan, broadcast, copy or show our work to an audience.  However, the copyright owner is under no obligation to give such permission.

    Our products are intended for private use only.  Anybody wishing to use our products outside of private use are legally obliged to obtain a licence from the copyright holder.  Licences are available for purchase from this website with details listed below:

    DVDs Videos and Course Notes:

    An individual licence is required for each of our titles.  Once licensed the licence owner can use multiple copies of DVDs, Videos and Course Notes purchased from us for the following:

  • To show our films to an audience within the compounds or the licence holders premises or campus etc.
  • To lend our films to employees or students of the licence holder.
  • To make copies of our course notes.
  • Under no circumstances can copies be made of our films, in whole or in part.

    Basic Block Patterns

    The very nature of our ready made basic block patterns is for them to be copied, although we must stress that this can be for personal use only.

    PLEASE NOTE

    Licences cannot be held by local authorities for use by multiple sites.  Each individual site, company, college, school or university must own their own licence issued by us.

    Copyright licences are required for all new purchase from 1st April 2008 onwards.
